Terms of Service

1. Acceptance of Terms

By accessing or using edu.games you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the platform.

2. Description of Service

edu.games is a learning-games platform comprising a marketplace, developer, teacher and student portals, an xAPI Learning Record Store, and documentation. It connects game developers, educators, and students.

3. Accounts & Eligibility

You must provide accurate registration information and keep your credentials secure. Certain roles, such as developer and teacher accounts, require approval. The platform is intended for use by and within educational institutions.

4. Acceptable Use

You may not use the platform for unlawful purposes, interfere with the Learning Record Store or other users, or upload game content that is malicious, infringing, or unsuitable for an educational audience.

5. Developer Content & Licensing

Developers retain ownership of the games they publish and grant edu.games a licence to host, display, and distribute those games to institutions. Developers warrant that they hold all necessary rights and that their content is appropriate for educational use. Developers are responsible for the accessibility of their games and are asked to disclose each game’s accessibility level so that institutions and learners can make an informed choice. 6. Purchases, Pricing & Payments

Prices are set by developers and/or edu.games and are processed through Stripe. Developer revenue share and payout terms apply as separately agreed. You are responsible for any applicable taxes.

7. Refunds

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. If a game or service you purchase is faulty, not fit for purpose, or does not match its description, you are entitled to a remedy — which may include a replacement, repair, or refund — in accordance with the Australian Consumer Law. To request a remedy, contact us at legal@edu.games with your order details. We do not otherwise provide refunds for change of mind.

8. Intellectual Property

The edu.games name, branding, and platform are the intellectual property of edu.games and may not be used without permission.

9. Learning Data & xAPI

Our handling of learning-record and personal data is governed by our Privacy Policy and any agreement with the relevant institution.

10. Data Processing Agreement

Where edu.games processes personal data on behalf of an institution as a data processor under the GDPR or an equivalent law, our Data Processing Agreement applies to that processing and is incorporated into, and forms part of, these Terms. Institutions that require a countersigned copy for procurement purposes may request one from legal@edu.games.

11. Disclaimers & Limitation of Liability

The platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law — and subject always to guarantees and rights that cannot be excluded under the Australian Consumer Law — edu.games disclaims all warranties and limits its liability arising from your use of the platform.

12. Indemnification

You agree to indemnify edu.games against claims arising from your misuse of the platform or from content you provide.

13. Termination

Either party may terminate access to the platform. On termination, provisions relating to content, data, and liability survive as applicable.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after changes take effect constitutes acceptance.
